Four men were also arrested for allegedly raping Brooks or being witnesses to the rape before dropping her near the crash scene. Records show that Brooks’ blood alcohol level at the time of death was four times higher than the legal limit. Investigators claim that the victim and four suspects met in a bar on 14 January; the autopsy report also confirmed that Brooks was the victim of sexual assault.
A warrant of arrest states that Washington, an unidentified 17-year-old, and Lee were both charged with rape in the third degree, while Carver and Lee were charged as principals of third-degree rape.
Affidavits state that one of the suspects, Casen Carver, claimed he had never met Madison Brooks or known her. He claimed that Brooks was with him and the other suspects when they were leaving the bar.
Carver said Brooks was “very unstable” on her feet, “unable to keep her balance,” “unable to speak without slurring words,” and that he saw Brooks with the male 17-year-old as they “hugged and walked together.”
He offered Brooks to take her home, but she was unable to respond because she was unstable. Carver parked his car on a nearby road, and the 17-year-old and Brooks had sex on the backseat. Carver claimed that after the 17-year-old had sex in Brooks’ car, he heard Washington asking her “numerous” times if she would like to have sex. “She consented.”
Carver and Washington’s Uncle, Lee, were in the front seats while “sex was being performed” with Brooks. After that, Carver stated, “We have to stop this.” Carver couldn’t find Brooks’ home, so he dropped Brooks off “in an area subdivision,” but Brooks died at 2:50 am when she was hit by a car.
